  1. Agreement

    These are the conditions of the Agreement between you (“you”) and Railbookers America, Inc (“Railbookers”, “we”, “us” and “our”) of 601 South Figueroa Street, Suite 4050, Los Angeles CA 90017. When you book a service an Agreement is formed as soon as a deposit or full payment is made and you agree to be bound by the terms of this Agreement.
  2. Responsibility and Liability Disclaimer

    Railbookers is an intermediary and acts only in the capacity of agent for you in all matters of accommodation, transportation and other services. You will be entering into a separate contract with suppliers and service providers (“Supplier” and “Suppliers”) in connection with products and services purchased. Railbookers has no liability for any act, omission or default, whether negligent or otherwise, of any Supplier or other third party. Railbookers is not a provider of services and has no responsibility for services provided or not provided by any party. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased services. We have no responsibility for these services nor do we make or give any warranty or representation regarding their standard. All bookings are made subject to the terms and conditions and limitations of liability imposed by these Suppliers in accordance with the laws of the countries in which the services are supplied in addition to our general terms and conditions. All receipts, tickets or vouchers are issued subject to the terms and conditions under which services are provided. The issuance and acceptance of receipts, tickets, or vouchers shall be deemed consent to the above conditions.

    Prior to booking overseas travel you should review the United States Government’s current warnings, advisories and prohibitions applicable to your chosen destinations. By offering travel to any particular destination we do not warrant that travel to such destination is safe or without risk.

    Railbookers shall not be held responsible nor will compensation be paid nor will any refunds of any nature whatsoever be made when accidents, damage, changes or cancellations occur as a result of war, threat of war, riot, civil strife, terrorism, strikes (including, but not limited to, strikes and official or unofficial industrial action by rail operators, train operating companies, track operators or otherwise), industrial disruption, natural disaster, adverse weather conditions, fire, government action or other events beyond our control.

    The information, software, products, and services published on our website www.railbookers.com may include inaccuracies or errors, including pricing errors. Railbookers does not guarantee the accuracy of, and disclaims all liability for any errors or other inaccuracies relating to the information and description of travel products and services displayed on our website (including but not limited to the pricing, photographs, list of hotel amenities, general descriptions etc.). Railbookers reserves the right to correct any pricing errors on our website and/or on pending reservations made under an incorrect price. In such event, if available, we will offer you the opportunity to keep your pending reservation at the correct price or we will cancel your reservation without penalty.

    Hotel ratings displayed on our website are intended as general guidelines only and do not guarantee the accuracy of the ratings. Railbookers makes no guarantees about the availability of specific products and services.

    Railbookers makes no representations about the suitability of the information, software, products, and services contained on our website for any purpose, and the inclusion or offering of any products or services on our website does not constitute any endorsement or recommendation of such products or services. All such information, software, products, and services are provided "as is" without warranty of any kind.     If, despite the limitation above, Railbookers or our respective suppliers are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then the liability of Railbookers and/or our respective suppliers will in no event exceed, in the aggregate, the greater of (a) the service fees you paid to us in connection with such transaction(s), or (b) one-hundred dollars (US$100.00) or the equivalent in local currency.

    The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose. The limitations of liability provided in these terms inure to the benefit of Railbookers and/or our respective Suppliers.

  3. Seller of Travel

    Railbookers America, Inc is a registered Seller of Travel in California (CST 2110539-40) and participates in the California Travel Consumer Restitution Fund. Please note that registration as a Seller of Travel does not constitute approval by the State of California.

    California law requires certain sellers of travel to have a trust account or bond. Railbookers America, Inc has a trust account.

    This information is for customers who are located within California: Transactions with Railbookers America, Inc are covered by the California Travel Consumer Restitution Fund (TCRF) if the seller of travel was registered and participating in the TCRF at the time of sale and the passenger is located in California at the time of payment. Eligible passengers may file a claim with TCRF if the passenger is owed a refund of more than $50 for transportation or travel services which the seller of travel failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRF within 12 months after the scheduled completion date of the travel. A claim must include sufficient documentation to prove your claim and a $35 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a TCRF claim.   4. Travel Insurance

    We strongly recommend that you take out comprehensive travel and health insurance at time of booking and that the policy should include, but not be limited to the following features: loss of deposit and/or final payment, injury, death, theft, loss of luggage and personal items, curtailment of tours en-route, medical expenses, additional expenses to cover hotel accommodation and repatriation costs should your holiday need to be extended or curtailed due to illness while overseas.

  5. Pricing

    Railbookers reserves the right to correct any errors in rates quoted or calculated for any service. All quoted prices are subject to availability. All confirmed bookings are issued with an invoice detailing the services booked and it is your responsibility to check all details are correct. If any service is still on request this will be indicated on the invoice. Some services such as train tickets cannot be booked until 45 days prior to the service and any increase in the quoted fares are required to be paid by you. We strongly recommend that you take out comprehensive travel and health insurance at time of booking and that the policy should include, but not be limited to the following features: loss of deposit and/or final payment, injury, death, theft, loss of luggage and personal items, curtailment of tours en-route, medical expenses, additional expenses to cover hotel accommodation and repatriation costs should your holiday need to be extended or curtailed due to illness while overseas.

    Prices are subject to change in the event of devaluations in US Dollar exchange rates greater than 5% or increases in supplier costs beyond our control. No surcharge will apply once final payment is received.

    Local taxes vary from country to country and are included in the price unless otherwise stated.

  6. Deposit

    To secure a booking a 25% non-refundable deposit will be required for all services within 7 days upon receipt of invoice. Minimum deposit is $100 per booking. In some cases you may be required to pay a larger deposit and/or complete full payment and this will be advised to you at the time of booking.

  7. Final Payment

    Final payment must be received 90 days before the commencement of your travel arrangements. If the final payment is not received on time, the booking will be treated as cancelled and subject to applicable cancellation fees.

  8. Payment Methods

    Payments may be made by wire transfer or by major credit or debit cards via PayPal. Third party credit cards are not acceptable.

  9. Amendments

    If you want to change anything to do with your booking, we will do our best to assist you, but we cannot guarantee to make the changes you want or at all. Some special terms and conditions apply to certain services and these will be advised at time of booking. In all other cases the following administration charges will be made: $50 per person plus any additional supplier fees.

  10. Cancellations

    Cancellations can only be made in writing via email to inquiry@railbookers.com and are subject to the following cancellation penalties:

    • 91 days or earlier prior to departure – Loss of Deposit
    • From 60 to 90 days prior to departure – 50% of package price
    • From 46 to 59 days prior to departure - 75% of package price
    • 45 days or less prior to departure - 100% of package price

    Some special terms and conditions apply to certain services and these will be advised at time of booking. There is no refund permitted on cruises, Orient-Express or Trans-Siberian journeys. There is no refund on rail or airline tickets.

  11. Documentation

    It is your responsibility to check the accuracy of your travel documentation and advise us immediately if there are any discrepancies or errors. Your travel documents are valuable and it is not always possible to replace travel documents in the case of loss/theft/damage etc. Lost rail tickets cannot be reissued.

    Documentation is normally issued within 3 weeks of your travel commencement. If you are departing prior to this, it may be necessary to courier documents at your own expense to an overseas address. Documents are issued on paper and shipped via Express Mail within the United States.

  12. Accommodation

    Accommodation standards vary quite dramatically from country to country and hotel rooms are often smaller than the equivalent properties in the United States. Railbookers have rated hotels according to a number of criteria including standard, facilities and location. While these may be the same ratings as those given by the appropriate tourist authority sometimes this is not the case since standards vary. Railbookers does not warrant the availability of published or indicative amenities or facilities which are the responsibility of the relevant provider.

    In European hotels the operation of the heating and air-conditioning often differs greatly from the United States and may operate at the discretion of the Hotel Manager and may be regulated by local laws. Tea and Coffee making facilities may not be available in all rooms and additional charges may apply. The type and standard of breakfast varies from hotel to hotel and in some hotels supplements may apply for hot items. Hotel check-in times vary and are generally not before 3pm and check-out time is prior to noon.

    Bedding requests at hotels cannot be guaranteed as hotels may have limited availability of certain bedding types. Double rooms may have twin beds or double beds and it is common practice for double rooms to be single beds linked together. Single rooms are often smaller than other rooms and may contain only a single bed; a supplement can be paid for a double room to be used for single occupancy. Triple rooms usually consist of either a double or twin bedded room with an additional sofa bed, folding bed or rollaway for the third person so may not always be suitable for adults. Please make any specific bedding requests at the time of booking.

  13. Customer Service

    If you are unhappy with the accommodation or any services we have provided, you should tell the owner or manager of the property immediately. If they fail to put things right and the enjoyment of your trip is affected, please contact us so we can try to solve the problem while you are still on your trip. Refunds will not be considered by hotels if they were not given an opportunity to address complaints locally. Any written complaints must be made to us via email to inquiry@railbookers.com within 30 days of your return and processing may take up to eight weeks from the date that Railbookers receives the relevant documents.

  14. Unused Services

    No refunds will be given for services not utilized. Furthermore Railbookers is not bound to comply with promises of refunds made by employees of our Suppliers.

  15. Passport and Visas

    It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities of any country or territory that you enter or transit through. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. All travelers must have a valid passport for international travel and many countries require at least 6 months validity from the date of entry. We cannot accept liability for any loss you may suffer because you are not in possession of the correct travel documents.

  16. Health

    Vaccinations are strongly recommended for certain destinations. Please contact your healthcare provider for up-to-date information. Please note that vaccinations may be recommended some period in advance of traveling. It is your responsibility to ensure that you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation

    Some countries require aircraft cabin insecticide treatment for inbound flights and further information can be found at www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements

  17. Transport

    Railbookers acts as an agent of the transport provider and the conditions of carriage of the transport carrier apply to your journey. If transport Suppliers make minor changes to your original schedule we will inform you as soon as possible but cannot guarantee to do so. If transport Suppliers make what we deem to be a major change to your original schedule such as alteration of a departure time by more than 12 hours we will inform you as soon as possible but if you opt to cancel as a result, you will be liable for normal cancellation charges.

  18. Names

    All names, titles and initials of those traveling must be correctly given at the time of booking. If you are purchasing or arranging a booking on behalf of someone else you must ensure you have each passenger name as per their passport. If you provide us with incorrect passenger names, name changes will not be permitted and you will have to purchase a new ticket subject to availability.

  19. Special Requests

    If you have any special request, you must advise us in writing at the time of booking. Although we will endeavor to pass any reasonable requests on to the relevant Supplier, we cannot guarantee any request will be met unless we have specifically confirmed this. For your own protection, you should obtain confirmation in writing from us that your request will be complied with (where it is possible for us to give this) if your request is important to you. Confirmation that a special request has been noted or passed on to the Supplier or the inclusion of the special request on your confirmation invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability. We cannot accept any conditional bookings, i.e. any booking which is specified to be conditional on the fulfillment of a particular request. All such bookings will be treated as “standard” bookings subject to the above provisions on special requests.

  20. Privacy

    You agree Railbookers and its Suppliers may collect, retain, use and disclose your personal information in accordance with our Privacy Policy. Our Privacy Policy sets out how we will manage your personal information and is available on our website www.railbookers.com.

  21. Indemnification

    You agree to indemnify us, our affiliates, our Suppliers and any such parties’ officers, directors, employees and agents from and against any claims, demands, losses, causes of action, damages, recoveries, fines, penalties or other costs (including but not limited to reasonable accounting and legal fees) brought by you or third parties as a result of a) your breach of this Agreement; b) your violation of any law or rights of any third party; or c) your use of our website.

  22. General

    We reserve the right to modify this Agreement at any time without prior notice at our sole discretion. The most current version of this Agreement may be found at our website www.railbookers.com. You may not assign your rights or obligations under this Agreement to any third party. This Agreement shall be governed by the laws of the State of California. If any provision of this Agreement shall be deemed invalid, illegal or unenforceable, the enforceability of the remaining provisions shall not in any way be affected or impaired. You hereby consent to the exclusive jurisdiction and venue of courts in Los Angeles County, California, USA in any legal proceedings both on behalf of and against Railbookers America, Inc. Any legal proceedings against Railbookers America, Inc must commence no later than 180 days after the date of departure.

    You agree that no joint venture, partnership, or employment relationship exists between you and Railbookers as a result of this Agreement or use of our website.
